General Terms and Conditions (GTC)

Milennium Travels

​

1. Basic Information                                                                                                                        

These General Terms and Conditions (“GTC”) govern the legal relationship between the client (“Client”) and Milennium Travels, as operator of the brand Milennium Travels, hereinafter referred to as “We”.

For the sake of clarity, these GTC apply to all services provided by Milennium Travels and Form an integral part of every contract concluded between Milennium Travels and the Client.

Only the version of the GTC in force at the time of conclusion of the Contract shall apply.

Should any provision of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

2. Place of Jurisdiction and Applicable Law

Any dispute arising out of or in connection with this Contract shall fall under the exclusive jurisdiction of the courts of Loulé, Portugal, unless a different mandatory jurisdiction is required by law.

All contractual relationships, reservations, additional agreements, and these General Terms and Conditions shall be governed exclusively by Portuguese law.

The place of performance and payment shall be the registered office of Milennium Travels.


3. Definitions                                                                                                                                        

For the purposes of these General Terms and Conditions:                                                    

“Written confirmation” shall mean any communication in written Form, including but not limited to letters and e-mail messages.

The contracting parties to the Contract are the Client and Milennium Travels.                           

4. Subject matter of the contract / scope of application
We provide professional chauffeur-driven transport services, including but not limited to: Airport transfers; Corporate travel; Hourly hire. All services are subject to availability. Bookings must be made in advance via phone, email, or our website.                                       Full payment or a deposit may be required prior to service.                                                     Prices are quoted in EUR € and include standard services unless otherwise stated.

Additional charges may apply for: Tolls and parking; Excess mileage; Cleaning fees                  

 

 

5. Scope of Services

The scope of services under the Contract shall be determined exclusively by the individual reservation made and confirmed by the Client.  Unless otherwise expressly agreed in writing, the Client shall have no entitlement to a specific vehicle model or brand, but only to a vehicle within the booked category.

6. Waiting Time

The Clients are entitled to 1 hour waiting time free of charge on specific services. Any delays beyond this period will lead to termination of the service with no possibility of refund unless communicated prior to the delay.

7. Period of Use and Duration

The period of use shall commence at the scheduled pick-up time confirmed in the reservation and shall end upon completion of the service at the agreed final destination.

For services booked on an hourly basis, the minimum booking duration shall be one (1) hour. Any additional time used beyond the booked period shall be charged in accordance with the applicable hourly rate.

Waiting time, delays caused by the Client, and any deviations from the agreed itinerary shall be included in the period of use and may result in additional charges.

8. Client Responsibilities
The Client’s responsibilities include: Providing accurate and complete booking information; Ensuring that all passengers behave respectfully and in a lawful manner; Being financially responsible for any damage to the vehicle or excessive cleaning required as a result of their conduct.                                                                                                                    

The Client shall be liable for repair or cleaning costs up to a maximum amount of €1000.00.

Smoking, possession or consumption of illegal substances, and unsafe or abusive behaviour are strictly prohibited and may result in immediate termination of the service without refund.

 9.  Company Responsibilities

We commit to: Providing licensed, insured vehicles; Employing professional, trained drivers; Making reasonable efforts to arrive on time.      We are not liable for delays caused by: Traffic conditions; Weather; Accidents; Force majeure events                                                                   

10. Cancellation of the reservation / Cancellation fees
Cancellation made 48 hours before pick up free of charge. Cancellations within 12-24 hours may incur up to 100% of the booking fee. No shows are charged in full.

11. Liability

We are not liable for loss of flights, meetings, or business opportunities. Our maximum liability is limited to the value of the booking.

12. Use of the Vehicle

The use of the vehicle must comply with Portuguese law.

Seat belts are compulsory.

13. Service Termination

We may immediately terminate the service if: Safety is compromised; The Customer is intoxicated or aggressive.

The service will be terminated without refund.

14. Data Protection

Personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR).

The data collected is used exclusively for the purpose of providing the contracted services and will not be disclosed to third parties except where required by law.

15. Alternative Dispute Resolution (ADR / RAL)

In accordance with Law no. 144/2015, the Client is entitled to resort to an Alternative Dispute Resolution (ADR) entity for the resolution of consumer disputes.

16.  Amendments

Milennium Travels reserves the right to amend these Terms and Conditions at any time.

The version in force shall be the one published at the time of the reservation.

 

By using our services, you acknowledge that you have read and accepted these General Terms and Conditions.
